Administrative procedures for the verification of residency  2006-2007

Every student who is enrolled in the Barbers Hill Independent School District shall be required to provide proof of residency at the beginning of each school year to the building principal or designee at the campus on which they are to be enrolled.

Proof of Residency for Real Property Owners and Tenants

A student whose parent or legal guardian, or other person having lawful control under a court order, which own, lease, or rent a residence within the boundaries of the District shall provide proof of residency by presenting a valid receipt for utilities.  Valid utility receipt will only consist of a current cable, electricity, gas, telephone, or water utility receipt, which must include a physical address for the subject residence.  For any resident whose rent or lease fees may include payment of utilities and for which no such evidence is available, a signed and dated rental receipt including rental amount and physical address for the subject residence must be provided.

Students shall be required to provide such proof of residency as a condition of enrollment each year at the Barbers Hill Intermediate, Middle and High Schools.  For students who are to be enrolled on the Primary and Elementary campuses, such proof shall be submitted each year along with the updated emergency and health information as required by each campus by no later than the end of the first six-weeks grading period.  Failure to provide such information in a timely manner may result in the immediate withdrawal of the student(s) in question.

Proof of Residency for Students (with a Parent and Legal Guardian) Residing in the Home of a District Resident

Proof of residency for students who may reside with a parent or legal guardian in the home of a District resident, shall be required to provide proof of residency by affidavit as sworn before a Notary Public of the State of Texas.  Any student for whom admission is sought under these conditions shall be required to secure the affidavit form from the appropriate campus and shall be further required to execute said documents before a Notary Public prior to enrollment.  After the affidavit is notarized, it must be approved by the Superintendent’s Office, then may be presented to each campus and maintained there. All students who may be enrolled on the basis of a sworn affidavit shall be required to renew the affidavit each year as a condition of continued enrollment.

Proof of Residency for Students Residing in the Home with a Person having Lawful Control

Students living with a Person having lawful control under a court order must provide a copy of the court order to the Superintendent or designee to receive permission to enroll.  The Person having lawful control of the student shall be required to show proof of residency by presenting a valid receipt for utilities (i.e., cable, electricity, gas, telephone, water) which must include a physical address for the subject residence.

Enforcement of District Policy FDA (LOCAL) as Related to Admissions and Attendance

District Policy FDA (LOCAL) provides that "no nonresident students shall be permitted to attend District schools" except that "children of nonresident District employees shall be eligible for tuition-free attendance in District schools."  Pursuant to the policy, the District shall make reasonable efforts to ensure the legal residency of all students enrolled in the District.  Beyond required proof of residency as described above, all reports of issues relating to nonresidency as may be submitted by District employees, students, or parents shall be promptly investigated within the limits of available resources, including, but not limited to, the District Student Resource Officer.   Students who may be identified as nonresidents shall be withdrawn from the District immediately, except in instances where a resident student has become a nonresident during the course of a semester.  In such cases, Policy FDA (LOCAL) provides that the student may continue in attendance for the remainder of the semester in which the relocation occurred.  In all cases where enrollment may be granted on the basis of false records or documents, the parties to such offense may be liable for tuition or other costs as specified in the Texas Education Code, Section 25.001 and may, as well, be subject to prosecution under Section 37.10 of the Texas Penal Code.  [top]
